Permits for Transportation, Storage, Distribution and Public Sale of Petroleum, Oils, Petrochemicals and Biofuels.

Dispositions for the obtainment of permits for the transportation, storage, distribution and public sale of petroleum, oils, petrochemicals and biofuels issued by the Regulatory Commission of Energy.

Derived from the constitutional reform adopted on December 20th, 2013, in which Articles 25, 27 and 28 of the Mexican Constitution were amended, participation of private entities has been allowed in intermediation activities ? transportation, storage, distribution, commercialization and public sales ? of hydrocarbons.

Articles 45 Section II of the Hydrocarbons Law and 6 of such Law?s Regulation, provide that for the execution of the activities of transportation storage, distribution, commercialization and public sales?of hydrocarbons, oils and petrochemicals, as well as for the management of integrated systems, particulars will require a permit to be issued by the Regulatory Commission of Energy (the ?Commission?).

As of January 1st, 2015, the Commission has been authorized to grant permits and authorizations within its scope of jurisdiction, with the exception of permits for the sale to the public of gasoline and diesel, which may be granted until January 1st, 2016.

As per the foregoing, on the last days, the Commission has issued and published in the Official Gazette the general administrative provisions which provide the models for the final permits to be granted for the execution of the following activities:

  • Transportation through pipeline of petroleum, unprocessed natural gas, oils, petrochemicals and biofuels.
  • Transportation through tanker of petroleum and oils.
  • Transportation by other means of petroleum and oils.
  • Distribution through pipeline of oils and biofuels.
  • through other means of oils.
  • Storage of petroleum, oils, petrochemicals and biofuels.
  • Storage in self- service stations of oils.
  • Storage in aerodromes.
  • Selling in service stations of oils and biofuels
  • Selling in aerodromes of oils
  • Management of integrated systems of oils and petrochemicals.
