Amendments to the Federal?

Consumer Protection Law

The Federal Consumer Protection Law seeks to protect the consumer?s rights and call for legal certainty in the relationships between providers and consumers.

Due to this reason, the Law confers certain authorities to the Federal Consumer?s Board authorizing it to adopt the measures and carry out the acts which are necessary to protect those relationships.

Through Decree published in the Official Gazette on July 10, 2009, article 24 fraction XXI and article 25 BIS of the abovementioned law, which refer to the faculties that are given to the Federal Consumer?s Board, were amended as follows:

  1. Before the amendment, article 24 fraction XXI, granted powers to the Federal Consumer?s Board so that it could mandate that the consumers be informed about the provider?s actions or omissions that affected their rights or interests, as well as the form in which the providers would remunerate or compensate them. Through the analyzed amendment, the Federal Consumer?s Board has been additionally given the authority to issue immediate alerts to the consumers about the products, practices regarding the provision of products and services considered harmful or that may put at risk the life, health or the consumer?s security, when such risk has been entirely certified by the competent authority.
  2. As a consequence, article 25 BIS, which allows the employment of preventive measures by the Federal Consumer?s Board, has been amended granting it the authority to mandate the removal of goods or services from the market, if the competent authority has entirely certified that such goods put at risk the consumers? lives or health.

It is evident that the amendment seeks to protect the life and health of all the consumers, conferring broad faculties to the Federal Consumer?s Board to carry out all the preventive measures that may attempt against them.
