Commercial Litigation
Our team has successfully represented both domestic and foreign companies in commercial disputes. Civil Litigation
In civil litigation, our team handles matters involving the performance and breach of civil contracts, contractual and non-contractual liability, as well as ownership and possession of real and personal property.
We have extensive experience managing disputes arising from contractual relationships, including donations, purchase and sale agreements, leases, powers of attorney, loan for use agreements, deposit agreements, and, generally, all types of contracts, whether or not expressly regulated by law.
Likewise, we have successfully participated in family law and estate matters, providing ongoing counsel to our clients during both the out-of-court and judicial stages.
Constitutional Litigation
In the field of constitutional litigation, we have extensive experience in high-profile cases involving constitutional law, human rights, and international treaties in civil and commercial matters before the Supreme Court of Justice of the Nation and Mexico’s Federal Courts.
Some of our successful cases have involved freedom of expression, due process rights, and rights to privacy and reputation, among other constitutional matters.
Representative Matters
We handled more than 20 simultaneous litigation proceedings on behalf of a leading real estate company, in which the minority shareholder group, which controlled 40% of the company, carried out a capital increase through a shareholders’ meeting in an attempt to dilute the majority shareholders’ equity interest and thereby take control of the company, its facilities, bank accounts and assets.
One of the industrial parks involved in the dispute houses BMW’s assembly plant in San Luis Potosí, representing an investment of approximately one billion dollars.
Our team successfully intervened to prevent the hostile takeover of the company, avoiding the immediate seizure of the company, its facilities, bank accounts and assets through the implementation of a strategic litigation plan that enabled the majority shareholder to preserve its rights while the proceedings advanced. Favorable rulings have been obtained across three levels of court, and the matter ultimately reached the Mexican Supreme Court.
We advised a well-known company in the livestock industry, actively participating in insolvency 2.proceedings to implement a comprehensive financial restructuring of assets valued at approximately USD 58 million, with the purpose of safeguarding the company’s assets and ensuring its continuity.
We advised the minority shareholder group (U.S. and Canadian citizens) of a real estate company that developed an 85-unit private development project in Puerto Vallarta, Jalisco, valued at more than USD 6.5 million, in which our clients were excluded from the company through hostile actions by a Mexico-based partner seeking to seize control of our clients’ shares and benefit from the company’s assets.
We represented our clients in commercial litigation proceedings, obtaining injunctive relief and freezing the real estate and cadastral records of the properties comprising the development, thereby preventing the transfer of ownership of such assets until control of our clients’ shares is restored.
We handled litigation proceedings representing a leading financial sector company in a dispute against a manufacturing company located in Monterrey, Nuevo León, and Saltillo. A legal strategy was implemented to recover our client’s assets, resulting in the attachment of 58 properties belonging to the joint obligor and majority shareholder of the company, ultimately achieving a debt restructuring through a judicial settlement agreement.
We represented a renowned television actor, presenter, and artist in judicial proceedings initiated by Televisa International LLC, which alleged breach of contract related to the production of the biographical series of a globally recognized singer. The opposing party sought injunctive measures intended to prevent our client from exercising his professional and labor rights.
Our defense successfully overturned the injunctive measures previously granted, allowing our client to continue freely exercising his professional rights.
We represented a leading pharmaceutical company in legal proceedings arising from a payment dispute with one of its distributors, obtaining a pre-trial freezing order over bank accounts in connection with a debt exceeding MXN 48 million. Our team successfully opened a favorable negotiation channel for our client.
We successfully participated in litigation proceedings in which we were engaged at the appellate stage, after an adverse first-instance judgment had declared the nullity of several legal acts, potentially resulting in the loss of approximately USD 155 million in assets for a real estate company.
