Amendment of the Federal Civil
Code regardin Adoption
Adoption is a legal act that establishes a link of relationship between two people with an analogous relation to paternity. Mexican legislation establishes certain requirements and conditions in order for people to adopt, such as having the legal capacity to exercise their civil rights.
In order to increase the number of people that are eligible to adopt, on Monday April the 8th a decree was published by the Secretary of Government (SG) amending and removing several provisions of the Federal Civil Code regarding Adoption
This amendment to Article 391 states that besides spouses, concubines are also eligible to adopt when they agree to hold the adopted as their son/daughter, notwithstanding that only one of them is above the age of 25 years old, and the difference between the adopters and adoptee must be at least 17 years old.
Furthermore, by virtue of the mentioned amendment, the rights and obligations of what was known as ?Simple Adoption? cease to exist leaving only ?Full and International Adoption? as options for adopting as contained in the Third Section in Articles 410 A to 410 F of the aforementioned Code.
