Through Decree published in the Official Gazette in June 29, 2010, The Legislative Power amended the articles 429 of the Federal Criminal Code and the 223 Bis of the Intellectual Property Law.
The 429th article of the Federal Crime Code, which is found in the 26th Title, named ?Copyright Crimes?, has been amended as follows:
?Article 429.- The crimes established in this Title, will be persecuted by own motion, except for what articles 424, 1st fraction and article 427 provide.?
In regards to the amendment of article 223 Bis of the Intellectual Property Law, which is found in the Third Chapter, named ?Of Crimes?, has been amended as follows:
?Article 223 Bis.- Any person that sells fake trademark objects, in an intentional way and with a commercial motive, in streets or public sites, will be punished with a prison term from two to six years and a fine from a hundred to ten thousand days the minimum wage in the Federal District. If the sale occurs in commercial establishments, or in an organized or permanent way, one should attend to articles 223 and 224 of this Law. This crime will be persecuted by own motion.?
