The Law of Foreign Investment establishes the requirement of obtaining a permit of the Ministry of Foreign Affairs whereby it authorizes the name required for the incorporation of a company. Likewise, authorization of that same Ministry is required when the companies change their trade name. Such request was originally negotiated before the Direction of Constitutional Article 27 Permissions of the General Direction of Legal Matters of the Ministry of Foreign Investment.
Nevertheless, through Decree published in the Official Gazette in August 4, 2009, it was agreed that the reception and resolution of the requests regarding the licenses for the use of a trade name for constituting a company, and the notices regarding the use of such licenses, may be carried out by electronic media, through the Federal Government internet?s entry in www.tuempresa.gob.mx.
With this, the reduction of bureaucratic procedures is sought, with the objective to break down the discretionality and to simplify the administrative procedures in order to render a prompt and more efficient service in respect to the constitution of companies.
www.tuempresa.gob.mx puts the citizen at the center of the process of the opening of a company, without the need to do multiple rows in diverse windows, consequently saving time, costs, and avoiding duplicities upon capturing a single time the information of its business.
